The Family of a Man Fatally Shot by Rochester Police Says They Will Sue

The family of a man who was shot to death by police in Rochester is planning to sue.

Brendan Burns was gunned down last month during a foot chase. Police said he had been linked to two gunfire incidents, and they said he pointed a shotgun at law enforcement officers and ignored repeated orders to drop it.

Civil rights attorney Nate McMurray says in a statement the pursuit was reckless. He says Burns was walking calmly with his mother, was in poor mental health and made no threats. He says only some of the body camera footage has been released, and the family wants to see the rest.

The state attorney general is investigating the use of deadly force.
